<p>These answers are based on the provisions of the Consumer Assistance to Recycle and Save Act of 2009.</p>
<p><strong>What is the Car Allowance Rebate System?</strong></p>
<p>The Car Allowance Rebate System is a new program from the government that will help you pay for a new, more fuel efficient car or truck from a participating dealer when you trade in a less fuel efficient car or truck.</p>
<p><strong>What is NHTSA doing to implement the program?</strong></p>
<p>As required under the law, NHTSA will publish rules for the program in 30 days. We are currently working closely with manufacturers, dealers, and disposal facilities to get a workable, effective program up and running.</p>
<p><strong>Do I need to get a voucher or sign up for this program?</strong></p>
<p>No. You do not need a voucher and you are not required to sign up or enroll in this program. Participating new car dealers will apply a credit, reducing the price you pay at the time of your purchase or lease, provided the vehicle you buy or lease and the vehicle you trade in meet the program requirements. The dealer will then obtain reimbursement from the government.</p>
<p><strong>How do I know if a dealer is participating in the program?</strong></p>
<p>The law requires dealers to be registered to participate in the program. We are moving as quickly as possible to register interested dealers. As dealers are registered, we will list them on this website. We will continue to update this list during the life of the program. Meanwhile, you may wish to contact dealers in your area to ask whether they plan to participate in the program.</p>
<p><strong>How do I know if my car or truck is an eligible trade-in vehicle?</strong></p>
<p>There are several requirements (but you also have to meet certain conditions for the car or truck you wish to buy). Your dealer can help you determine whether you have an eligible trade in vehicle.</p>
<p>Your trade-in vehicle must</p>
<ul>
<li>have been manufactured less than 25 years before the date you trade it in</li>
<li>have a &#8220;new&#8221; combined city/highway fuel economy of 18 miles per gallon or less</li>
<li>be in drivable condition</li>
<li>be continuously insured and registered to the same owner for the full year preceding the trade-in</li>
</ul>
<p>Note that work trucks (i.e., very large pickup trucks and cargo vans) have different requirements.</p>
<p><strong>How do I find out when my vehicle was manufactured?</strong></p>
<p>The month and year of manufacture (e.g., 1-96 (January 1996)) appear on the safety standard certification label that is located on the frame or edge of the driver&#8217;s door in most vehicles.</p>
<p><strong>How do I find out the combined city/highway fuel economy rating of my trade-in vehicle?</strong></p>
<p>Visit our MPG Calculator and click on the model year of your vehicle, the make, and then the model. Under the words &#8220;ESTIMATED NEW EPA MPG&#8221; in the red banner, there is a red number with the word &#8220;COMBINED&#8221; under it. That is the new combined city/highway fuel economy for your vehicle. You may then enter the make, model, and model year of a new vehicle you may want to buy and see its combined MPG for comparison.</p>
<p><strong>Does the program apply if I want to lease a vehicle, or must I purchase a vehicle?</strong></p>
<p>Under the program, you may purchase a new vehicle or lease a new vehicle, provided the lease period for the new vehicle is at least five years.</p>
<p><strong>Is there a cap on the price of the vehicle I can buy or lease under the program?</strong></p>
<p>Yes. The manufacturer&#8217;s suggested retail price cannot exceed $45,000.</p>
<p><strong>Does the program apply if I want to buy a used car?</strong></p>
<p>No. The program does not apply to the purchase of used vehicles.</p>
<p><strong>What is the amount of the credit?</strong></p>
<p>The amount of the credit is $3,500 or $4,500, and generally depends on the type of vehicle you purchase and the difference in fuel economy between the purchased vehicle and the trade-in vehicle. Different requirements apply for work trucks.</p>
<p><strong>In addition to the credit, will I get the full value of my trade-in vehicle?</strong></p>
<p>No. The law requires your trade-in vehicle to be destroyed. Therefore, the value you negotiate with the dealer for your trade-in vehicle is not likely to exceed its scrap value. The law requires the dealer to disclose to you an estimate of the scrap value of your trade-in vehicle.</p>
<p><strong>I don&#8217;t drive an American car but I would like to trade in my old car for a newer, more fuel efficient one. Is this program only for American cars?</strong></p>
<p>No. You may trade in or buy a domestic or a foreign vehicle.</p>
<p><strong>I have a truck and I cannot find its fuel economy rating. Is it an eligible trade-in vehicle?</strong></p>
<p>Maybe. Some trucks, such as work trucks, were never rated for fuel economy. For these trucks, age is the only criterion for determining whether they are eligible trade-in vehicles. If you have one of these trucks, it must be from model year 2001 or earlier, but also the date of manufacture must be less than 25 years from the date you trade it in, to be an eligible trade-in vehicle. Other restrictions may also apply.</p>
<p><strong>I just traded in my old car for a new vehicle last month. Will I get some money back?</strong></p>
<p>No. The program does not apply retroactively.</p>
<p><em><span style="text-decoration: underline;"><strong>The following FAQ was created by <a href="http://Edmunds.com">Edmunds.com</a></strong></span></em></p>
<p><strong>How much are the vouchers worth?</strong> This will depend on the car you are turning in and the type of car you buy. In general, if the improvement in fuel economy between your old car and the car you buy is 10 mpg (combined highway mileage according to the EPA), the maximum credit will be $4,500. The requirement for improvement in fuel economy for trucks is lower. For specifics, see the above chart.</p>
<p><strong>How old does my car need to be?</strong> Eligible vehicles must be manufactured in model year 1984 or later. For work trucks however, any model built before 2002 is eligible. We anticipate that most cars traded in will likely be model-year 2000 and older.</p>
<p><strong>What types of vehicles qualify?</strong> In general, this bill aims to take polluting gas-guzzlers off the road. The vehicle must have a federal combined city/highway fuel economy of 18 or less miles per gallon. This means that many American-made cars and trucks will be eligible for vouchers toward the purchase of new vehicles. The categories of vehicles that will qualify fall into four classes: passenger cars, light-duty trucks, large light-duty trucks (6,000-8,500 pounds) and work trucks (8,500-10,000 pounds).</p>
<p><strong>What kind of mpg will the new vehicle need to get?</strong> Different levels of improvement are required for each type of vehicle. In passenger cars, if mileage is improved by 10 mpg, the $4,500 voucher is awarded; if fuel economy is improved by only 4 mpg, the $3,500 voucher is awarded. The mileage improvement levels and voucher amounts for the different classes of trucks are listed in the chart above.</p>
<p><strong>The proposal mentions a one-year time limit. Is there a cap on the number of vehicles?</strong> The bill is written to provide vouchers for 1 million purchases. Since there is a one-year limit, consumers who are interested in taking advantage of this program should track the progress of the bill and apply for a voucher as soon as funds become available. There is a special provision in the bill that requires that no more than 7.5 percent of the funds for the program shall be used for work trucks.</p>
<p><strong>How long do I need to have owned the vehicle I&#8217;m trading in?</strong> The vehicle must be insured and registered in your name and in use for at least one year.</p>
<p><strong>If I have an older car that is in good running condition, or a classic car, is it mandatory for me to turn it in?</strong> No. This program is completely voluntary.</p>
<p><strong>What happens to the car that you trade in?</strong> The dealer is responsible for sending the vehicle to a disposal facility. The entire vehicle will be crushed or shredded so that the car does not end up on the road again.</p>
<p><strong>How will this affect used-car values?</strong> Since the &#8220;clunkers&#8221; will be taken off the road, there will be fewer older vehicles in the marketplace. However, our analysts don&#8217;t expect this program to drastically affect used-car values.</p>
<p><strong>Where do I find the mpg numbers to see if my vehicle qualifies for the Cash for Clunkers vouchers?</strong> The EPA&#8217;s combined mileage will be used. This is a combination of the highway and city mileage for vehicles. Models prior to 2008 will use the converted MPG numbers which take into account the new EPA testing methods. This information can be found on the window sticker of the car or at <a href="http://fueleconomy.gov">fueleconomy.gov</a>.</p>
<p><strong>What kind of vehicles qualify as light-duty and large light-duty trucks?</strong> Trucks qualify based on class and vehicle weight. For example, the Ford F-150 would be considered a light-duty truck. If you are considering taking advantage of this program, look up your vehicle on Edmunds.com and determine its weight. If it is between 6,000 and 8,500 pounds and gets less than 15 mpg, you have a large light-duty truck and will need to buy a truck that improves your fuel economy by 1 mpg for a $3,500 voucher. If you select a truck that improves fuel economy by at least 2 mpg, you will qualify for the $4,500 voucher. A work truck is classified as being between 8,500 and 10,000 pounds. The only requirement for this class is that the trade-in vehicle needs to have been built before model-year 2002.</p>
<p><strong>When is the program expected to go into effect, and will it be retroactive?</strong> Passage of this bill could come before the end of July and the vouchers would be available shortly thereafter. It will not be retroactive to any vehicle purchase made before the bill is passed. The current House legislation was folded into a broader energy package and was passed on June 9, 2009. Now it will go to the Senate, where it undoubtedly will go through further changes.</p>
<p><strong>Where will the money for vouchers come from?</strong> Since President Obama wants this to move as quickly as possible, it is likely that the money will come from the already approved Troubled Asset Relief Program (TARP) funds and the economic stimulus package.</p>
<p><strong>Does the voucher augment or replace what the dealer would give me for my trade-in?</strong> The money you receive from the Cash for Clunkers program will act as your trade in value. It cannot be combined with the dealer&#8217;s trade in offer. This program is primarily designed to inflate the value of older vehicles worth less than $4,500.</p>
<p><strong>Is there a limit on the price of the vehicle purchased with Cash for Clunkers vouchers?</strong> Vehicles purchased with the vouchers must have an MSRP of $45,000 or less.</p>
<p><strong>How will the program be tracked?</strong> Via dealers or the DMV? Little information has been made available on this aspect of the bill. It is likely, though, that the Vehicle Identification Number (VIN) will be the prime tool in verifying information on the trade-in vehicle such as model year, engine size and the corresponding EPA-rated fuel-economy levels. The government has numerous databases with information on cars that are tracked through their VIN.</p>
<p><strong>How will you get the money toward the trade-in?</strong> An electronic transfer from the government to the dealer will be issued once a vehicle is determined to be qualified for the Cash for Clunkers program. The voucher amount would be credited as all or part of the down payment on a qualifying new car.</p>
<p><strong>Will it apply to used-car purchases?</strong> The final details of the bill are not yet available. However, it has always been assumed that the vouchers will only apply to new car purchases.</p>
<p><strong>What if you&#8217;re leasing a vehicle and wish to trade it in?</strong> Again, final details are not available. But it is unlikely that consumers who are currently leasing vehicles will qualify for this program.</p>
<p><strong>What if you wish to lease the new vehicle?</strong> In this case, it appears likely that the voucher could be applied to a leased vehicle as a &#8220;capitalized cost adjustment.&#8221; This would lower the price of the vehicle and thus reduce the monthly payment of a lease. In order for a lease to qualify, the term must be for no less than five years. However, we don&#8217;t recommend getting into a five-year lease because of the additional costs.</p>
<p><strong>I hear there is another version of the bill, how does this version differ?</strong> Senate Bill S. 1200, sponsored by Senator Dianne Feinstein, is a more environmentally focused alternative to the House version. The Senate version has a staggered voucher structure that increases the voucher&#8217;s value based on the mpg improvement. The Senate bill also lowers the mpg requirement for cars and trucks, but raises the mpg limit on the new vehicle.</p>

<p>We recognize that a lot needs to happen to achieve the objectives set forth by this government program and we also realize that the best way to achieve these objectives is for the private sector to contribute as much or more to this mission as the public sector has. 			<content:encoded><![CDATA[<p>The Consumer Assistance to Recycle and Save Program will save jobs and help remove less-efficient cars from the road.  Similar legislation recently passed in the House Energy and Commerce Committee by a 50-4 bipartisan vote.</p>
<p>Automotive sales continue to decline in the United States. Last month, vehicle sales fell to a rate below 9 million vehicles (annualized) down from 17.5 million vehicles in 2005 &#8211; more than a 40 percent decline. Jumpstarting the nation&#8217;s auto manufacturing sector will help dealers, workers, suppliers, communities and will provide significant benefits for consumers. All automakers selling vehicles in the United States have vehicles eligible for the program, which is WTO compliant.</p>
<p><strong>Benefits from the program:</strong></p>
<ul>
<li><strong>Saves Jobs:  </strong>Foreign and domestic auto dealers support thousands of jobs across the country.  From sales to administrative staff to advertising outlets to local suppliers, many dealerships are being forced to close or cut back because new vehicle sales are down.  This bill will give a boost to consumers whose confidence has been dwindling.  The Consumer Assistance to Recycle and Save Program will send buyers back into showrooms to keep people working in cities and towns across America. <strong></strong></li>
<li><strong>Economic Stimulus:</strong>  U.S. new vehicle sales are down nearly 40 percent compared to a year ago, due in large part to the credit crisis, job losses, and dwindling consumer confidence. The Consumer Assistance to Recycle and Save Program will help drive vehicle sales and increase economic activity, while supporting automakers &#8211; foreign and domestic &#8211; and the jobs they provide. The stimulus is timely, temporary and targeted.  The program will have the added benefit of providing much needed sales tax revenues to the states.</li>
<li><strong>Main Street </strong><strong>Savings:</strong> Consumers will benefit from an incentive to purchase a new vehicle and the cost savings from buying less fuel. The Department of Energy estimates a consumer who drives a vehicle that gets 30 mpg will save approximately $780 a year compared to a vehicle that gets 18 mpg ($2.34/gallon and 15,000 miles driven/year).</li>
<li><strong>Reductions in Fuel Consumption: </strong>In addition to saving jobs the program will save fuel.  As buyers turn in their older, less efficient cars more fuel efficient vehicles will take their place.  The fuel savings could exceed one billion gallons per year.</li>
<li><strong>Lower CO2 and Criteria Pollutant Emissions: </strong>If the program removes 10 percent of the V-8 engines from the road, carbon dioxide emissions will be reduced by tens of millions of metric tons annually. Plus, recycling old vehicles and replacing them with new ones will yield considerable reductions in pollution because the Clean Air Act requires significantly more stringent vehicle emission standards for today&#8217;s new cars and trucks. For example, the EPA requires new vehicles to produce at least 75 percent fewer oxides of nitrogen (NOx) emissions than those made in 2001.</li>
</ul>
<p><strong>Details of the Program: </strong></p>
<p>Under the program, consumers may trade in their older vehicles and receive vouchers worth up to $4,500 toward the purchase or qualified lease of a new, more fuel-efficient car or truck.  The program will be authorized from 7-1-09 to 11-1-09 and will provide for approximately 250,000 new car or truck purchases.</p>
<p>According to the Drive America Forward Bill the below summarizes the terms of the program:</p>
<ul>
<li>Be in drivable condition</li>
<li>Be continuously insured and registered to the same owner for at least one year</li>
<li>Have a combined fuel economy value of 18 mpg or less (Work trucks must be pre-2002 regardless of mpg)</li>
<li>Not be more than 25 years old with historic or aesthetic value. These vehicles are valued by hobbyists or are a valuable source of restoration parts.</li>
</ul>
<p><span style="text-decoration: underline;">Funding</span>:</p>
<p>The program will receive an initial allocation of $1B funded by the US government, attached the war supplemental bill</p>
<p><span style="text-decoration: underline;">Length</span>: the program  time length is 7/1&#8211;11/1</p>
<p><span style="text-decoration: underline;">New vehicles</span></p>
<ul>
<ul>
<li>The new vehicle must have a manufacturer&#8217;s suggested retail price of less than $45,000,</li>
<li><span style="text-decoration: underline;">Passenger Cars:</span>  The older vehicle must get 18 mpg or less.  New passenger cars with mileage of at least 22 mpg are eligible for vouchers.  If the mileage of the new car is at least 4 mpg higher than the old vehicle, the voucher will be worth $3,500.  If the mileage of the new car is at least 10 mpg higher than the old vehicle, the voucher will be worth $4,500.</li>
<li><span style="text-decoration: underline;">Small Trucks and SUVs:</span>  The old vehicle must get 18 mpg or less.  New small trucks or SUVs with mileage of at least 18 mpg are eligible for vouchers.  If the mileage of the new truck or SUV is at least 2 mpg higher than the old vehicle, the voucher will be worth $3,500.  If the mileage of the new truck or SUV is at least 5 mpg higher than the old vehicle, the voucher will be worth $4,500.</li>
<li><span style="text-decoration: underline;">Large Light-Duty Trucks:</span>  The old vehicle must get 18 mpg or less.  New large trucks (pick-ups and vans weighing between 6,000 and 8,500 pounds) with mileage of at least 15 mpg are eligible for vouchers.  If the mileage of the new truck is at least 1 mpg higher than the old truck, the voucher will be worth $3,500.  If the mileage of the new truck is at least 2 mpg higher than the old truck, the voucher will be worth $4,500.</li>
<li><span style="text-decoration: underline;">Work Trucks:</span>  Under the agreement, consumers can trade in a pre-2002 work truck (defined as a pick-up truck or cargo van weighing from 8,500-10,000 pounds) and receive a voucher worth $3,500 for a new work truck in the same or smaller weight class.  Only 7.5 percent of the total funds can be used for vouchers for the purchase or lease of a work truck. There are no EPA mileage measures for these trucks; however, because newer models are cleaner than older models, the age requirement ensures that the trade will improve environmental quality.  Consumers can also &#8220;trade down&#8221;, receiving a $3,500 voucher for trading in an older work truck and purchasing a pick-up or van weighing between 6,000-8,500 lbs.</li>

<ul>Sec. 1301. Short Title- This title may be cited as the &#8216;Consumer Assistance to Recycle and Save Act of 2009&#8242;.</ul>

<ul>Sec. 1302. Consumer Assistance to Recycle and Save Program-</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(a) Establishment- There is established in the National Highway Traffic Safety Administration a voluntary program to be known as the &#8216;Consumer Assistance to Recycle and Save Program&#8217; through which the Secretary, in accordance with this section and the regulations promulgated under subsection</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(d), shall&#8211; (1) authorize the issuance of an electronic voucher, subject to the specifications set forth in subsection</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(c), to offset the purchase price or lease price for a qualifying lease of a new fuel efficient automobile upon the surrender of an eligible trade-in vehicle to a dealer participating in the Program;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(2) register dealers for participation in the Program and require that all registered dealers&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(A) accept vouchers as provided in this section as partial payment or down payment for the purchase or qualifying lease of any new fuel efficient automobile offered for sale or lease by that dealer; and</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(B) in accordance with subsection</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(c)(2), to transfer each eligible trade-in vehicle surrendered to the dealer under the Program to an entity for disposal;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(3) in consultation with the Secretary of the Treasury, make electronic payments to dealers for eligible transactions by such dealers, in accordance with the regulations issued under subsection (d); and</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(4) in consultation with the Secretary of the Treasury and the Inspector General of the Department of Transportation, establish and provide for the enforcement of measures to prevent and penalize fraud under the program.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(b) Qualifications for and Value of Vouchers- A voucher issued under the Program shall have a value that may be applied to offset the purchase price or lease price for a qualifying lease of a new fuel efficient automobile as follows:</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(1) $3,500 VALUE- The voucher may be used to offset the purchase price or lease price of the new fuel efficient automobile by $3,500 if&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(A) the new fuel efficient automobile is a passenger automobile and the combined fuel economy value of such automobile is at least 4 miles per gallon higher than the combined fuel economy value of the eligible trade-in vehicle;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(B) the new fuel efficient automobile is a category 1 truck and the combined fuel economy value of such truck is at least 2 miles per gallon higher than the combined fuel economy value of the eligible trade-in vehicle;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(C) the new fuel efficient automobile is a category 2 truck that has a combined fuel economy value of at least 15 miles per gallon and&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(i) the eligible trade-in vehicle is a category 2 truck and the combined fuel economy value of the new fuel efficient automobile is at least 1 mile per gallon higher than the combined fuel economy value of the eligible trade-in vehicle; or</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(ii) the eligible trade-in vehicle is a category 3 truck of model year 2001 or earlier; or</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(D) the new fuel efficient automobile is a category 3 truck and the eligible trade-in vehicle is a category 3 truck of model year of 2001 or earlier and is of similar size or larger than the new fuel efficient automobile as determined in a manner prescribed by the Secretary.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(2) $4,500 VALUE- The voucher may be used to offset the purchase price or lease price of the new fuel efficient automobile by $4,500 if&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(A) the new fuel efficient automobile is a passenger automobile and the combined fuel economy value of such automobile is at least 10 miles per gallon higher than the combined fuel economy value of the eligible trade-in vehicle;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(B) the new fuel efficient automobile is a category 1 truck and the combined fuel economy value of such truck is at least 5 miles per gallon higher than the combined fuel economy value of the eligible trade-in vehicle; or</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(C) the new fuel efficient automobile is a category 2 truck that has a combined fuel economy value of at least 15 miles per gallon and the combined fuel economy value of such truck is at least 2 miles per gallon higher than the combined fuel economy value of the eligible trade-in vehicle and the eligible trade-in vehicle is a category 2 truck.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(c) Program Specifications-</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(1) LIMITATIONS-</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(A) GENERAL PERIOD OF ELIGIBILITY &#8211; A voucher issued under the Program shall be used only in connection with the purchase or qualifying lease of new fuel efficient automobiles that occur between July 1, 2009 and November 1, 2009.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(B) NUMBER OF VOUCHERS PER PERSON AND PER TRADE-IN VEHICLE- Not more than 1 voucher may be issued for a single person and not more than 1 voucher may be issued for the joint registered owners of a single eligible trade-in vehicle.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(C) NO COMBINATION OF VOUCHERS- Only 1 voucher issued under the Program may be applied toward the purchase or qualifying lease of a single new fuel efficient automobile.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(D) CAP ON FUNDS FOR CATEGORY 3 TRUCKS- Not more than 7.5 percent of the total funds made available for the Program shall be used for vouchers for the purchase or qualifying lease of category 3 trucks.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(E) COMBINATION WITH OTHER INCENTIVES PERMITTED- The availability or use of a Federal, State, or local incentive or a State-issued voucher for the purchase or lease of a new fuel efficient automobile shall not limit the value or issuance of a voucher under the Program to any person otherwise eligible to receive such a voucher.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(F) NO ADDITIONAL FEES- A dealer participating in the program may not charge a person purchasing or leasing a new fuel efficient automobile any additional fees associated with the use of a voucher under the Program.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(G) NUMBER AND AMOUNT- The total number and value of vouchers issued under the Program may not exceed the amounts appropriated for such purpose.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(2) DISPOSITION OF ELIGIBLE TRADE-IN VEHICLES-</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(A) IN GENERAL- For each eligible trade-in vehicle surrendered to a dealer under the Program, the dealer shall certify to the Secretary, in such manner as the Secretary shall prescribe by rule, that the dealer&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(i) has not and will not sell, lease, exchange, or otherwise dispose of the vehicle for use as an automobile in the United States or in any other country; and</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(ii) will transfer the vehicle (including the engine block), in such manner as the Secretary prescribes, to an entity that will ensure that the vehicle&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(I) will be crushed or shredded within such period and in such manner as the Secretary prescribes; and</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(II) has not been, and will not be, sold, leased, exchanged, or otherwise disposed of for use as an automobile in the United States or in any other country.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(B) SAVINGS PROVISION- Nothing in subparagraph (A) may be construed to preclude a person who is responsible for ensuring that the vehicle is crushed or shredded from- -</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(i) selling any parts of the disposed vehicle other than the engine block and drive train (unless with respect to the drive train, the transmission, drive shaft, or rear end are sold as separate parts); or (ii) retaining the proceeds from such sale.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(C) COORDINATION- The Secretary shall coordinate with the Attorney General to ensure that the National Motor Vehicle Title Information System and other publicly accessible systems are appropriately updated on a timely basis to reflect the crushing or shredding of vehicles under this section and appropriate reclassification of the vehicles&#8217; titles. The commercial market shall also have electronic and commercial access to the vehicle identification numbers of vehicles that have been disposed of on a timely basis.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(d) Regulations- Notwithstanding the requirements of section 553 of title 5, United States Code, the Secretary shall promulgate final regulations to implement the Program not later than 30 days after the date of the enactment of this Act. Such regulations shall&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(1) provide for a means of registering dealers for participation in the Program;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(2) establish procedures for the reimbursement of dealers participating in the Program to be made through electronic transfer of funds for the amount of the vouchers as soon as practicable but no longer than 10 days after the submission of information supporting the eligible transaction, as deemed appropriate by the Secretary;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(3) require the dealer to use the voucher in addition to any other rebate or discount advertised by the dealer or offered by the manufacturer for the new fuel efficient automobile and prohibit the dealer from using the voucher to offset any such other rebate or discount;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(4) require dealers to disclose to the person trading in an eligible trade-in vehicle the best estimate of the scrappage value of such vehicle and to permit the dealer to retain $50 of any amounts paid to the dealer for scrappage of the automobile as payment for any administrative costs to the dealer associated with participation in the Program;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(5) consistent with subsection (c)(2), establish requirements and procedures for the disposal of eligible trade-in vehicles and provide such information as may be necessary to entities engaged in such disposal to ensure that such vehicles are disposed of in accordance with such requirements and procedures, including&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(A) requirements for the removal and appropriate disposition of refrigerants, antifreeze, lead products, mercury switches, and such other toxic or hazardous vehicle components prior to the crushing or shredding of an eligible trade-in vehicle, in accordance with rules established by the Secretary in consultation with the Administrator of the Environmental Protection Agency, and in accordance with other applicable Federal or State requirements;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(B) a mechanism for dealers to certify to the Secretary that each eligible trade-in vehicle will be transferred to an entity that will ensure that the vehicle is disposed of, in accordance with such requirements and procedures, and to submit the vehicle identification numbers of the vehicles disposed of and the new fuel efficient automobile purchased with each voucher;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(C) a mechanism for obtaining such other certifications as deemed necessary by the Secretary from entities engaged in vehicle disposal; and</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(D) a list of entities to which dealers may transfer eligible trade-in vehicles for disposal; and</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(6) provide for the enforcement of the penalties described in subsection (e).</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(e) Anti-Fraud Provisions-</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(1) VIOLATION- It shall be unlawful for any person to violate any provision under this section or any regulations issued pursuant to subsection (d) (other than by making a clerical error).</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(2) PENALTIES- Any person who commits a violation described in paragraph (1) shall be liable to the United States Government for a civil penalty of not more than $15,000 for each violation. The Secretary shall have the authority to assess and compromise such penalties, and shall have the authority to require from any entity the records and inspections necessary to enforce this program. In determining the amount of the civil penalty, the severity of the violation and the intent and history of the person committing the violation shall be taken into account.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(f) Information to Consumers and Dealers- Not later than 30 days after the date of the enactment of this Act, and promptly upon the update of any relevant information, the Secretary, in consultation with the Administrator of the Environmental Protection Agency, shall make available on an Internet website and through other means determined by the Secretary information about the Program, including&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(1) how to determine if a vehicle is an eligible trade-in vehicle;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(2) how to participate in the Program, including how to determine participating dealers; and</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(3) a comprehensive list, by make and model, of new fuel efficient automobiles meeting the requirements of the Program. Once such information is available, the Secretary shall conduct a public awareness campaign to inform consumers about the Program and where to obtain additional information.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(g) Record Keeping and Report-</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(1) DATABASE- The Secretary shall maintain a database of the vehicle identification numbers of all new fuel efficient vehicles purchased or leased and all eligible trade-in vehicles disposed of under the Program.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(2) REPORT ON EFFICACY OF THE PROGRAM- Not later than 60 days after the termination date described in subsection (c)(1)(A), the Secretary shall submit a report to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate describing the efficacy of the Program, including&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(A) a description of Program results, including&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(i) the total number and amount of vouchers issued for purchase or lease of new fuel efficient automobiles by manufacturer (including aggregate information concerning the make, model, model year) and category of automobile;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(ii) aggregate information regarding the make, model, model year, and manufacturing location of vehicles traded in under the Program; and</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(iii) the location of sale or lease;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(B) an estimate of the overall increase in fuel efficiency in terms of miles per gallon, total annual oil savings, and total annual greenhouse gas reductions, as a result of the Program; and</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(C) an estimate of the overall economic and employment effects of the Program.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(h) Exclusion of Vouchers From Income-</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(1) FOR PURPOSES OF ALL FEDERAL AND STATE PROGRAMS- A voucher issued under this program or any payment made for such a voucher pursuant to subsection (a)(3) shall not be regarded as income and shall not be regarded as a resource for the month of receipt of the voucher and the following 12 months, for purposes of determining the eligibility of the recipient of the voucher (or the recipient&#8217;s spouse or other family or household members) for benefits or assistance, or the amount or extent of benefits or assistance, under any Federal or State program.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(2) FOR PURPOSES OF TAXATION- A voucher issued under the program or any payment made for such a voucher pursuant to subsection (a)(3) shall not be considered as gross income of the purchaser of a vehicle for purposes of the Internal Revenue Code of 1986.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(i) Definitions- As used in this section&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(1) the term &#8216;passenger automobile&#8217; means a passenger automobile, as defined in section 32901(a)(18) of title 49, United States Code, that has a combined fuel economy value of at least 22 miles per gallon;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(2) the term &#8216;category 1 truck&#8217; means a nonpassenger automobile, as defined in section 32901(a)(17) of title 49, United States Code, that has a combined fuel economy value of at least 18 miles per gallon, except that such term does not include a category 2 truck;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(3) the term &#8216;category 2 truck&#8217; means a large van or a large pickup, as categorized by the Secretary using the method used by the Environmental Protection Agency and described in the report entitled &#8216;Light-Duty Automotive Technology and Fuel Economy Trends: 1975 through 2008&#8242;;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(4) the term &#8216;category 3 truck&#8217; means a work truck, as defined in section 32901(a)(19) of title 49, United States Code;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(5) the term &#8216;combined fuel economy value&#8217; means&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(A) with respect to a new fuel efficient automobile, the number, expressed in miles per gallon, centered below the words &#8216;Combined Fuel Economy&#8217; on the label required to be affixed or caused to be affixed on a new automobile pursuant to subpart D of part 600 of title 40, Code of Federal Regulations;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(B) with respect to an eligible trade-in vehicle, the equivalent of the number described in subparagraph (A), and posted under the words &#8216;Estimated New EPA MPG&#8217; and above the word &#8216;Combined&#8217; for vehicles of model year 1984 through 2007, or posted under the words &#8216;New EPA MPG&#8217; and above the word &#8216;Combined&#8217; for vehicles of model year 2008 or later on the fueleconomy.gov website of the Environmental Protection Agency for the make, model, and year of such vehicle; or</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(C) with respect to an eligible trade-in vehicle manufactured between model years 1978 through 1985, the equivalent of the number described in subparagraph (A) as determined by the Secretary (and posted on the website of the National Highway Traffic Safety Administration) using data maintained by the Environmental Protection Agency for the make, model, and year of such vehicle.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(6) the term &#8216;dealer&#8217; means a person licensed by a State who engages in the sale of new automobiles to ultimate purchasers;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(7) the term &#8216;eligible trade-in vehicle&#8217; means an automobile or a work truck (as such terms are defined in section 32901(a) of title 49, United States Code) that, at the time it is presented for trade-in under this section&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(A) is in drivable condition;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(B) has been continuously insured consistent with the applicable State law and registered to the same owner for a period of not less than 1 year immediately prior to such trade-in;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(C) was manufactured less than 25 years before the date of the trade-in; and</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(D) in the case of an automobile, has a combined fuel economy value of 18 miles per gallon or less;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(8) the term &#8216;new fuel efficient automobile&#8217; means an automobile described in paragraph (1), (2), (3), or (4)&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(A) the equitable or legal title of which has not been transferred to any person other than the ultimate purchaser;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(B) that carries a manufacturer&#8217;s suggested retail price of $45,000 or less;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(C) that&#8211;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(i) in the case of passenger automobiles, category 1 trucks, or category 2 trucks, is certified to applicable standards under section 86.1811-04 of title 40, Code of Federal Regulations; or</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(ii) in the case of category 3 trucks, is certified to the applicable vehicle or engine standards under section 86.1816-08, 86-007-11, or 86.008-10 of title 40, Code of Federal Regulations; and</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(D) that has the combined fuel economy value of at least- &#8211; (i) 22 miles per gallon for a passenger automobile;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(ii) 18 miles per gallon for a category 1 truck; or</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(iii) 15 miles per gallon for a category 2 truck;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(9) the term &#8216;Program&#8217; means the Consumer Assistance to Recycle and Save Program established by this section;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(10) the term &#8216;qualifying lease&#8217; means a lease of an automobile for a period of not less than 5 years;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(11) the term &#8216;scrappage value&#8217; means the amount received by the dealer for a vehicle upon transferring title of such vehicle to the person responsible for ensuring the dismantling and destroying of the vehicle;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(12) the term &#8216;Secretary&#8217; means the Secretary of Transportation acting through the National Highway Traffic Safety Administration;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(13) the term &#8216;ultimate purchaser&#8217; means, with respect to any new automobile, the first person who in good faith purchases such automobile for purposes other than resale;</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(14) the term &#8216;vehicle identification number&#8217; means the 17 character number used by the automobile industry to identify individual automobiles; and</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>(15) the term &#8216;voucher&#8217; means an electronic transfer of funds to a dealer based on an eligible transaction under this program.</ul>
<p>&nbsp;</p>
<p>&nbsp;</p>
<p>&nbsp;</p>
<ul>
<ul>(j) Appropriation- There is hereby appropriated to the Secretary of Transportation $1,000,000,000, of which up to $50,000,000 is available for administration, to remain available until expended to carry out this section.</ul>

<p>The NHTSA says, &#8220;You do not need a voucher and you are not required to sign up or enroll in this program. Participating new car dealers will apply a credit, reducing the price you pay at the time of your purchase or lease, provided the vehicle you buy or lease and the vehicle you trade in meet the program requirements. The dealer will then obtain reimbursement from the government.&#8221;<br />

<p>This list is based on the requirements for the Cash for Clunkers program called C.A.R.S. &#8211; Title XIII of Bill H.R. 2346.<br />
This list was compiled by searching the Edmunds.com vehicle database for models that have an average fuel economy of 18 mpg or less and for which at least one of the styles of that vehicle has a current average national trade‐in True Market Valueprice (assuming clean vehicle condition and average mileage) of $4,500 or less. Accordingly, it is possible that some styles of a model may have a value higher than $4,500, and that the value of a particular vehicle may be higher because it is in exceptional condition or has very low mileage.</p>
<p>&nbsp;</p>
<p>Please note that almost all vehicles that are model year 1989 or earlier have a trade in value of less than $4,500, and for that reason we have not included them on this list. Exceptions include vehicles that had limited production runs, such as the 1984‐86 Buick Regal T Type Turbo, the 1985‐89 BMW 6 Series 635CSi, and the 1987‐89 Porsche 911 Carrera &#8211; as well as most collector and exotic vehicles.</p>
